Please read these terms and conditions carefully before using Our Service.

Interpretation and Definitions

Interpretation

The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

Definitions

For the purposes of these Terms and Conditions:

  • Application means the software program provided by the Company downloaded by You on any electronic device, named MusenAI

  • Application Store means the digital distribution service operated and developed by Apple Inc. (Apple App Store) or Google Inc. (Google Play Store) in which the Application has been downloaded.

  • Affiliate means an entity that controls, is controlled by or is under common control with a party, where "control" means ownership of 50% or more of the shares, equity interest or other securities entitled to vote for election of directors or other managing authority.

  • Country refers to: Spain

  • Company (referred to as either "the Company", "We", "Us" or "Our" in this Agreement) refers to MusenAI.

  • Device means any device that can access the Service such as a computer, a cellphone or a digital tablet.

  • Service refers to the Application or the Website or both.

  • Terms and Conditions (also referred as "Terms") mean these Terms and Conditions that form the entire agreement between You and the Company regarding the use of the Service.

  • Third-party Social Media Service means any services or content (including data, information, products or services) provided by a third-party that may be displayed, included or made available by the Service.

  • Website refers to MusenAI, accessible from https://musenai.live

  • You means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.

  • Credits refers to the in-app currency used to generate Radio Shows and Radio Streams within the Application.

  • Radio Show refers to AI-generated audio content created from user prompts featuring multiple voices discussing specific topics as specified by the user.

  • Radio Stream refers to AI-generated continuous audio content combining music, AI host commentary, and show segments based on user preferences.

  • AI Host refers to the artificial intelligence personalities featured within the Service, including but not limited to Zero One and Talia Blaze.

  • IPFS (InterPlanetary File System) refers to the decentralized storage protocol used by the Service to store and distribute content across a peer-to-peer network.

  • CID (Content Identifier) refers to the unique cryptographic hash identifier assigned to content stored on IPFS.

  • Pinata Gateway refers to the third-party service used by the Company to facilitate access to content stored on the IPFS network.

Acknowledgment

These are the Terms and Conditions governing the use of this Service and the agreement that operates between You and the Company. These Terms and Conditions set out the rights and obligations of all users regarding the use of the Service.

Your access to and use of the Service is conditioned on Your acceptance of and compliance with these Terms and Conditions. These Terms and Conditions apply to all visitors, users and others who access or use the Service.

By accessing or using the Service You agree to be bound by these Terms and Conditions. If You disagree with any part of these Terms and Conditions then You may not access the Service.

You represent that you are over the age of 18. The Company does not permit those under 18 to use the Service.

Your access to and use of the Service is also conditioned on Your acceptance of and compliance with the Privacy Policy of the Company. Our Privacy Policy describes Our policies and procedures on the collection, use and disclosure of Your personal information when You use the Application or the Website and tells You about Your privacy rights and how the law protects You. Please read Our Privacy Policy carefully before using Our Service.

User Data and Privacy

The Company only stores the following user information:

  • Email address

  • App usage data (such as generated content, preferences, and usage patterns)

We do not collect or store any additional personal information beyond what is necessary to provide the Service.

You have the right to request deletion of all your data at any time through the dedicated section on our website. Upon such request, we will permanently delete all information associated with your account.

Decentralized Storage of Content

IPFS Storage Architecture

The Service utilizes the InterPlanetary File System (IPFS), a peer-to-peer distributed file system, for storing audio content generated through the platform. Rather than storing content on centralized servers, IPFS distributes content across a decentralized network, providing enhanced resilience, improved scalability, and reduced dependency on centralized points of failure.

Content Storage Process

When you generate Radio Shows or Radio Streams through the Service:

  • The audio content is stored on the IPFS network

  • Each piece of content receives a unique Content Identifier (CID) based on its cryptographic hash

  • Content is accessed through the Pinata Gateway service which facilitates retrieval from the IPFS network

  • Your account maintains references to the CIDs of content you have generated

Benefits and Implications

This decentralized storage approach provides several benefits:

  • Enhanced content resilience through distributed redundancy

  • Improved scalability without proportional infrastructure costs

  • Reduced dependency on centralized points of failure

  • Content integrity verification through cryptographic hashing

Access to Stored Content

When you access your Radio Shows or Radio Streams through the Service:

  • The Company retrieves the content from the IPFS network via the Pinata Gateway

  • The content is streamed to your Device through the Application or Website

  • Downloaded content remains accessible to you even if stored locally

Content Persistence

Content stored on IPFS may remain accessible on the network even after deletion from the Service. By using the Service, you acknowledge:

  • Content may persist on the IPFS network beyond your relationship with the Service

  • The distributed nature of IPFS means complete removal of content cannot be guaranteed

  • The Company will remove references to your content from our systems upon request

User Accounts

When you create an account in the Application, you are responsible for maintaining the security of your account and the confidentiality of your password. You are fully responsible for all activities that occur under your account.

Payments and Credits

Payment Processing

All payments are processed securely through Stripe Checkout, a third-party payment processor. The Company does not store your payment information.

Credits System

  • Radio Shows cost 5 credits to generate

  • Radio Streams cost 1 credit to generate

  • Credits are purchased in packages as displayed in the Application

  • Credits are non-refundable once used to generate content

  • Unused credits remain in your account until used

User-Generated Content

Content Ownership

You retain ownership of the prompts you create to generate Radio Shows. However, the Company reserves the right to use anonymized prompts for improving the Service.

Public Content

When you choose to make a Radio Show "Public", you grant the Company permission to display this content to other users through the "Explore" feature of the Application.

Prohibited Content

You agree not to use the Service to generate content that:

  • Is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable

  • Infringes on any patent, trademark, trade secret, copyright, or other intellectual property rights

  • Impersonates any person or entity or falsely states or misrepresents your affiliation with a person or entity

  • Contains software viruses or any other code designed to interrupt, destroy, or limit the functionality of the Service

The Company reserves the right to remove any content that violates these terms and to suspend or terminate accounts that repeatedly violate these terms.

AI-Generated Content Disclaimer

Nature of AI-Generated Content

The Radio Shows, Radio Streams, and other content produced by MusenAI are generated by artificial intelligence systems. These outputs are created automatically in response to user prompts and have not necessarily been reviewed or verified by humans prior to delivery.

Limitations and Risks

While we strive to ensure high-quality results, AI-generated content may:

  • Contain factual inaccuracies, errors, or outdated information

  • Present statements, ideas, or audio elements as plausible even when they are untrue, misleading, or nonsensical (known as "AI hallucination")

  • Include references to events, people, places, or sources that do not exist or are fabricated

  • Exhibit unintended biases or potentially offensive material due to limitations in the underlying training data

  • Vary in quality depending on the specificity and clarity of the user prompt

No Warranty of Accuracy

We do not and cannot guarantee the accuracy, reliability, or completeness of any audio or other content generated by the AI. The Radio Shows and Radio Streams should be treated as creative or entertainment content rather than factual information sources.

User Responsibility

You acknowledge that you are responsible for reviewing and verifying any AI-generated content before relying on it or sharing it with others. This is especially important for content that purports to contain factual information, news, or instructional content.

Disclaimer for Public Content

When making your AI-generated content public through the "Explore" feature, you acknowledge that other users may access this content. You remain responsible for the prompts you provide and should not include sensitive, personal, or confidential information in prompts that generate public content.

Prohibited Uses

You agree not to use the Service to intentionally generate misleading content for the purpose of:

  • Spreading misinformation or disinformation

  • Creating fake news or falsified reports

  • Impersonating real individuals without their consent

  • Any other use that could reasonably cause harm or confusion

MusenAI as a Media Platform

Autonomous Media Platform Status

MusenAI constitutes an autonomous media platform predicated on artificial intelligence technologies. The platform functions as a novel media paradigm wherein content generation, curation, and distribution occur through computational processes with minimal human intervention. This represents a deliberate exploration of the capabilities and limitations of autonomous media systems in contemporary digital environments.

Conceptual Framework and Objectives

The fundamental objective of MusenAI is to establish and maintain a self-governing, AI-driven media ecosystem. The platform investigates the potential for AI systems to independently create, manage, and disseminate audio content within defined parameters, thereby examining emergent patterns of media production in the absence of traditional human editorial processes.

Disclaimer of Editorial Responsibility

The Company expressly disclaims any editorial responsibility for the content generated through the MusenAI platform. Unlike traditional media organizations that employ human editors to review, fact-check, and approve content prior to publication, MusenAI operates as a technological framework through which AI-generated content is created and distributed without systematic human oversight.

The absence of human editorial intervention is not an oversight but rather a foundational aspect of the platform's design, intended to examine the capabilities and limitations of autonomous content generation systems. Users are therefore advised that content encountered on the platform has not undergone conventional editorial review processes.

Research and Development Context

MusenAI operates within a research and development context that examines the intersection of artificial intelligence, media production, and user interaction. The platform continually evolves based on technological advancements, user feedback, and emergent patterns of usage.

By utilizing the Service, users implicitly participate in this investigation of autonomous media systems and acknowledge the experimental nature of the content generated through the platform. User interactions and feedback contribute valuable data that informs the ongoing development and refinement of autonomous media technologies.

Limitation of Liability

In accordance with the experimental nature of this autonomous media platform, and in addition to the limitations of liability stated elsewhere in these Terms and Conditions, the Company bears no responsibility for:

  1. The substantive content of any Radio Shows, Radio Streams, or other media generated through the platform

  2. Any factual assertions, opinions, or perspectives expressed within AI-generated content

  3. The potential impact or influence of such content on users or third parties

  4. Decisions made by users in reliance upon information contained in AI-generated content

  5. Any perceived alignment between AI-generated content and particular political, social, or ideological perspectives

Intellectual Property Rights

Company Intellectual Property

  1. Platform Ownership: All aspects of the MusenAI platform, including but not limited to the software application, website, backend systems, algorithms, APIs, database structures, user interfaces, and all technological components that enable the Service to function, are the exclusive property of the Company. This includes:

    • The Radio Mixer interface and its functionality

    • The Podcast Generator system and algorithms

    • The Dashboard and all user account management features

    • The AI-driven recommendation and personalization systems

    • The "Train Your Radio" preference learning system

    • All other technical features and components of the Service

    • The IPFS integration and content storage architecture

  2. Brand and Identity: The Company owns all rights to the MusenAI name, logo, visual identity, design elements, and brand assets, which are protected by trademark and copyright laws. Unauthorized use, reproduction, modification, or distribution of these elements is strictly prohibited. This includes:

    • The MusenAI name and wordmark

    • The MusenAI logo and icon

    • The distinctive visual design, color scheme, and user interface elements

    • Marketing materials and promotional content

  3. AI Host Personalities: The Company owns all intellectual property rights related to the AI host personalities featured in the Service, including but not limited to Zero One and Talia Blaze. This ownership extends to:

    • Character names, appearances, and personalities

    • Voice characteristics and speaking patterns

    • Backstories, traits, and characteristics

    • Visual representations and avatars

    • Any other distinctive elements of these AI personalities

  4. Generated Content: While users retain ownership of their prompts (as outlined below), the Company retains intellectual property rights to the underlying systems, algorithms, and methodologies used to generate content. This includes:

    • Audio generation frameworks

    • Voice synthesis systems

    • Content creation algorithms

    • IPFS integration and storage mechanisms

User Rights and Licenses

  1. Prompt Ownership: Users retain ownership of the specific prompts they create to generate Radio Shows. This ownership applies solely to the text of the prompt itself.

  2. License to Generated Content: When you generate content through the Service, the Company grants you a non-exclusive, non-transferable, personal license to use the AI-generated Radio Shows and Radio Streams for personal, non-commercial purposes. This license includes:

    • Listening to the content within the Application

    • Downloading content for personal use (where the feature is available)

    • Sharing content through the "Public" option within the Application

    • Accessing content via its IPFS Content Identifier (CID)

  3. Restrictions on Generated Content: The license granted above does not include:

    • Commercial use or monetization of AI-generated content without explicit written permission from the Company

    • Modification or derivative works based on the generated content for commercial purposes

    • Attribution of the content as human-created rather than AI-generated

    • Removal of any watermarks, attributions, or identifiers included in the content

    • Circumvention of the Service to access IPFS-stored content through alternative means

  4. Public Content Sharing: By choosing to make your generated Radio Shows "Public" within the Application:

    • You grant the Company a worldwide, royalty-free, perpetual, irrevocable license to display, distribute, and promote this content within the Service

    • You authorize other users to listen to this content through the "Explore" feature

    • You affirm that the content does not violate any third-party rights or contain prohibited material

    • You understand that your username may be displayed in association with this content

    • You acknowledge that content will be stored on the IPFS network and may persist beyond the lifespan of the Service

  5. Content Usage Terms: Downloaded content from Radio Shows:

    • May be used for personal, non-commercial purposes only

    • Must maintain any embedded attribution or metadata

    • Must not be presented as human-created content

    • Must not be used in ways that could damage or dilute the MusenAI brand

Third-Party Content and Services

  1. Licensed Content: Some audio elements, effects, or samples used within the Service may be licensed from third parties. Users receive no rights to these elements beyond what is expressly granted in these Terms.

  2. API and Integration Services: The Service may incorporate third-party APIs, services, or technologies, including the Pinata Gateway for IPFS content access. Use of the Service constitutes acceptance of any relevant terms imposed by these third-party providers.

  3. User-Uploaded Content: If the Service allows for user uploads (such as profile pictures), you represent and warrant that you own or have properly licensed any content you upload and grant the Company a non-exclusive license to store and display such content as needed to provide the Service.

Intellectual Property Restrictions

  1. Prohibited Activities: Users are strictly prohibited from:

    • Reverse engineering, decompiling, or disassembling any part of the Service

    • Extracting source code or attempting to access underlying algorithms

    • Creating derivative works based on the Company's proprietary systems

    • Scraping, crawling, or extracting data from the Service

    • Removing, altering, or obscuring any copyright, trademark, or proprietary notices

    • Circumventing the Service to access IPFS content directly using CIDs obtained through the Service

  2. Trademark Protection: The MusenAI name and logo are protected trademarks. Users may not:

    • Use these marks without prior written permission

    • Create confusingly similar marks or domain names

    • Suggest endorsement or affiliation with the Company

    • Use the marks in ways that dilute or damage their distinctive quality

  3. Attribution Requirements: When sharing or discussing content generated through the Service outside the Application:

    • Clearly indicate that the content was generated by MusenAI's artificial intelligence

    • Do not present AI-generated content as human-created

    • Provide appropriate attribution to MusenAI where relevant

  4. DMCA Compliance: The Company respects intellectual property rights and will respond to legitimate notices of copyright infringement. If you believe your copyrighted work has been used within the Service in a way that constitutes infringement, please contact us with the required DMCA notice information.

  5. Reservation of Rights: All rights not expressly granted to users in these Terms are reserved by the Company. The absence of an explicit restriction on certain uses does not imply permission.

Links to Other Websites

Our Service may contain links to third-party web sites or services that are not owned or controlled by the Company.

The Company has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party web sites or services. You further acknowledge and agree that the Company shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods or services available on or through any such web sites or services.

We strongly advise You to read the terms and conditions and privacy policies of any third-party web sites or services that You visit.

Termination

We may terminate or suspend Your access immediately, without prior notice or liability, for any reason whatsoever, including without limitation if You breach these Terms and Conditions.

Upon termination, Your right to use the Service will cease immediately.

Limitation of Liability

Notwithstanding any damages that You might incur, the entire liability of the Company and any of its suppliers under any provision of this Terms and Your exclusive remedy for all of the foregoing shall be limited to the amount actually paid by You through the Service or 100 USD if You haven't purchased anything through the Service.

To the maximum extent permitted by applicable law, in no event shall the Company or its suppliers be liable for any special, incidental, indirect, or consequential damages whatsoever (including, but not limited to, damages for loss of profits, loss of data or other information, for business interruption, for personal injury, loss of privacy arising out of or in any way related to the use of or inability to use the Service, third-party software and/or third-party hardware used with the Service, or otherwise in connection with any provision of this Terms), even if the Company or any supplier has been advised of the possibility of such damages and even if the remedy fails of its essential purpose.

Some states do not allow the exclusion of implied warranties or limitation of liability for incidental or consequential damages, which means that some of the above limitations may not apply. In these states, each party's liability will be limited to the greatest extent permitted by law.

"AS IS" and "AS AVAILABLE" Disclaimer

The Service is provided to You "AS IS" and "AS AVAILABLE" and with all faults and defects without warranty of any kind. Disputes Resolution

For European Union (EU) Users

If You are a European Union consumer, you will benefit from any mandatory provisions of the law of the country in which You are resident.

United States Legal Compliance

You represent and warrant that (i) You are not located in a country that is subject to the United States government embargo, or that has been designated by the United States government as a "terrorist supporting" country, and (ii) You are not listed on any United States government list of prohibited or restricted parties.

Severability and Waiver

Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.

Waiver

Translation Interpretation
